Welcome to the Propeller Aero Community Forum! These terms govern your use of the Internet forum located at https://community.propelleraero.com (the “Forum”). To use the Forum, you must agree to these terms with Propeller Aero Pty Ltd (“Propeller”, “we”, “us”), the company that runs the Forum.

Propeller may offer other products and services, such as the Propeller Platform, under different terms. These terms apply only to your use of the Forum.

Important Terms

These terms include a number of important provisions that affect your rights and responsibilities. These include the disclaimers in the “Disclaimers” section, limits on Propeller’s liability to you in “Limits on Liability”, your agreement to cover Propeller for damages caused by your misuse of the Forum in “Your Responsibility”, and an agreement to arbitrate disputes in the “Disputes” section. Your privacy rights, especially for users in Europe and California, are detailed in the “Privacy & Data Rights” section.

Your Permission to Use the Forum

Subject to these terms, Propeller gives you permission to use the Forum. The Forum is publicly viewable, but you must create an account and agree to these terms to post content, comment, or otherwise actively participate in the Forum.

Conditions for Use of the Forum

Your permission to use the Forum is subject to the following conditions:

  1. You must be at least eighteen (18) years old.

  2. You may no longer use the Forum if Propeller contacts you directly to say that you may not.

  3. You must use the Forum in accordance with the “Acceptable Use” and “Content Standards” sections.

Acceptable Use

  • You may not break the law using the Forum.

  • You may not use or try to use another’s account on the Forum without their specific permission.

  • You may not buy, sell, or otherwise trade in user names or other unique identifiers on the Forum.

  • You may not send advertisements, chain letters, or other commercial solicitations through the Forum, except in designated areas if provided.

  • You may not automate access to the Forum, or monitor the Forum, such as with a web crawler, scraper, or browser plug-in. You may crawl the Forum to index it for a publicly available search engine, if you run one.

  • You may not use the Forum to send e-mail to distribution lists, newsgroups, or group mail aliases.

  • You may not falsely imply that you’re affiliated with or endorsed by Propeller.

  • You may not embed any part of the Forum on other websites with an or similar technology without written permission.

  • You may not disable, avoid, or circumvent any security or access restrictions of the Forum.

  • You may not strain the infrastructure of the Forum with an unreasonable volume of requests or engage in any conduct that imposes an unreasonable load on our systems.

  • You may not impersonate others through the Forum.

  • You may not use the Forum to harvest or collect email addresses or other contact information.

  • You may not encourage or help anyone in violation of these terms.

Content Standards

  • You may not submit content to the Forum that is illegal, offensive, or otherwise harmful to others. This includes content that is harassing, inappropriate, abusive, hateful, discriminatory, threatening, or incites violence.

  • You may not submit content to the Forum that violates the law, infringes anyone’s intellectual property rights, violates anyone’s privacy, or breaches agreements you have with others.

  • You may not submit content that discloses confidential or proprietary information you do not have the right to disclose. This includes, but is not limited to, non-public details about your or your clients’ worksites, survey data, project plans, flight data, or business operations unless you have the full legal right and authority to do so.

  • You may not submit content to the Forum containing malicious computer code, such as computer viruses, malware, or spyware.

  • You may not submit content to the Forum as a mere placeholder to hold a particular address, user name, or other unique identifier.

  • You may not submit spam, repetitive content, or content that is misleading or deceptive.

  • You may not submit content that contains excessive promotional material unless in designated areas.

Enforcement

Propeller may investigate and prosecute violations of these terms to the fullest legal extent. We reserve the right to change, redact, and delete content on the Forum for any reason. We may also suspend or terminate accounts that violate these terms. If you believe someone has submitted content to the Forum in violation of these terms, please contact us immediately at community@propelleraero.com.

Your Account

While the Forum is publicly viewable, you must create and log into an account to post content, comment, participate in discussions, or access certain features. To create an account, you must provide a valid e-mail address and keep that address up-to-date. You may also be required to provide additional information such as your name and company affiliation. You may close your account at any time by e-mailing community@propelleraero.com.

You are responsible for all actions taken using your account, whether authorized by you or not, until you either close your account or notify us that your account has been compromised. You agree to notify us immediately at community@propelleraero.com if you suspect your account has been compromised. You agree to select a secure password and keep it secret.

Propeller may restrict, suspend, or close your account on the Forum if we reasonably believe that you have violated any rule in these terms or for any other reason at our sole discretion.

Your Content

Nothing in these terms gives Propeller any ownership rights in the intellectual property that you share with the Forum, such as your account information, posts, comments, or other content you submit (“Your Content”). Nothing in these terms gives you any ownership rights in Propeller’s intellectual property.

Between you and Propeller, you remain solely responsible for Your Content. You agree not to wrongly imply that Your Content is sponsored or approved by Propeller. You represent and warrant that you have all necessary rights to submit Your Content and grant the licenses described below.

Content you submit to the Forum belongs to you, and you decide what permission to give others for it. However, at a minimum, you grant Propeller a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute Your Content in connection with operating, promoting, and improving the Forum and our services. This license includes the right to make Your Content available to other users of the Forum, who may also use Your Content subject to these terms.

When Your Content is removed from the Forum, whether by you or by us, our license continues for reasonable backup, archival, and audit purposes, but Your Content will not be publicly displayed after removal.

Your Responsibility

You agree to indemnify and hold harmless Propeller, our officers, directors, employees, contractors, and agents from any and all legal claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your breach of these terms, (b) breach of these terms by others using your account, (c) Your Content, or (d) your violation of any laws or third-party rights.

Privacy & Data Rights

Your privacy is important to us. By using the Forum, you consent to the collection and use of certain information about you.

Data We Collect:

  • Account Information: Your name, email address, company affiliation, and any other information you provide for your profile.

  • User-Generated Content: Any posts, comments, questions, attachments, or media you submit to the Forum.

  • Technical Data: IP address, browser information, device information, and usage data collected via server logs and cookies to ensure the security and functionality of the Forum.

  • Activity Data: Information about your interactions with the Forum, including pages viewed, features used, and time spent.

How We Use Your Data:

  • To operate, maintain, and improve the Forum.

  • To communicate with you about your account, Forum activity, or updates to our services.

  • To enforce these terms and prevent abuse.

  • To analyze usage patterns to improve the Forum and our services.

  • To comply with legal obligations and protect our legal rights.

Data Retention:

We retain your personal data only for as long as necessary to fulfill the purposes outlined in these terms, unless a longer retention period is required by law.

Your Rights Under GDPR (For Users in the European Economic Area, UK, and Switzerland)

If you are a resident of the EEA, UK, or Switzerland, you have the following data protection rights:

Your Rights Under CCPA/CPRA (For California Residents)

If you are a California resident, you have specific rights regarding your personal information:

  • The right to know: What personal information we collect, use, disclose, and sell.

  • The right to delete: Request deletion of your personal information.

  • The right to correct: Request correction of inaccurate personal information.

  • The right to opt-out: We do not sell or share your personal information as defined under CCPA/CPRA.

Disclaimers

YOU ACCEPT ALL RISKS OF USING THE FORUM AND CONTENT ON THE FORUM. AS FAR AS THE LAW ALLOWS, PROPELLER AND ITS SUPPLIERS PROVIDE THE FORUM “AS IS”, WITHOUT ANY WARRANTY WHATSOEVER.

The Forum may hyperlink to services run by others. Propeller does not make any warranty about services run by others or content they may provide. Use of third-party services is at your own risk.

User-generated content on the Forum represents the views of individual users and does not necessarily reflect the views of Propeller. We do not endorse, support, or guarantee the completeness, truthfulness, accuracy, or reliability of any user-generated content.

Limits on Liability

AS FAR AS THE LAW ALLOWS, IN NO EVENT WILL PROPELLER OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE FORUM.

THE TOTAL LIABILITY OF PROPELLER AND ITS SUPPLIERS TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE FORUM OR CONTENT ON THE FORUM WILL BE LIMITED TO $100 USD.

In jurisdictions which do not allow limitations on implied warranties or liability for incidental or consequential damages our liability is limited to the greatest extent permitted by law.

Feedback

Propeller welcomes your feedback and suggestions for the Forum. By submitting feedback, you grant Propeller a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate your feedback into our services without compensation, attribution, or further permission from you.

Termination

Either you or Propeller may end the agreement in these terms at any time. When our agreement ends, your permission to use the Forum also ends, though you may continue to view publicly available content.

The following provisions survive the end of our agreement: “Your Content”, “Your Responsibility”, “Privacy & Data Rights”, “Disclaimers”, “Limits on Liability”, “Feedback”, “Disputes”, and “General Terms”.

Disputes

The laws of the State of Colorado, USA, without regard to its conflict of law provisions, will govern any dispute related to these terms or your use of the Forum.

You and Propeller agree to seek injunctions related to these terms only in state or federal court in Denver, Colorado, USA. Neither you nor Propeller will object to jurisdiction, forum, or venue in those courts.

Arbitration Agreement: Other than to seek an injunction or for disputes involving intellectual property rights, you and Propeller agree to resolve any dispute through binding individual arbitration before the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration will be conducted in Denver, Colorado, USA. The arbitrator’s decision will be final and enforceable in any court.

Class Action Waiver: You agree to resolve any dispute as an individual and not as part of a class action, collective action, or representative proceeding. The arbitrator may not consolidate multiple parties’ claims.

Opt-Out: You may opt out of this arbitration agreement by notifying us in writing within 30 days of first accepting these terms at community@propelleraero.com.

General Terms

Entire Agreement: These terms embody all the terms of agreement between you and Propeller about use of the Forum and supersede any prior agreements.

Severability: If a provision of these terms is unenforceable as written, it should be modified to the minimum extent necessary to make it enforceable. Otherwise, it should be removed, and the remaining provisions will continue in full effect.

Assignment: You may not assign your agreement with Propeller without our prior written consent. Propeller may assign this agreement to any affiliate or successor.

No Waiver: Propeller’s failure to enforce any provision of these terms will not be considered a waiver of our right to enforce that provision.

Force Majeure: Neither party will be liable for any failure or delay in performance due to circumstances beyond their reasonable control.

Changes to These Terms

Propeller may update these terms from time to time. We will post all updates to the Forum with the effective date. For updates that contain substantial changes, we will provide additional notice such as an email notification (if you have created an account and provided a valid email address) or a prominent notice on the Forum.

By continuing to use the Forum after changes become effective, you agree to be bound by the updated terms. If you do not agree to the updated terms, you must stop using the Forum.
